Terms and Conditions

The following Terms and Conditions apply to the use of this Web site as well as all transactions conducted through the site.

  • Nevertardy Transit, LLC waiver for minor/terms and conditions I, the undersigned parent/person having legal custody or guardianship of the above said minor, give permission for the minor to be a rider in the school bus service provided by Nevertardy Transit, LLC. The minor is physically able and mentally prepared to participate in this service provided by Nevertardy Transit, LLC. In consideration of said minor being permitted to use this service, I (as parent or guardian) hereby: 1. Acknowledge that (i) I have read this document, (ii) I am permitted to inspect the bus prior to its use, (iii) I accept it as being safe and reasonably suited for the purposes intended and (iv) I voluntarily sign this document. 2. Release Nevertardy Transit, LLC, its directors, officers, employees and volunteers (collectively “Releasees”) from all liability to me for any loss or damage to property or injury or death to person, whether caused by Releasees or otherwise and while such minor is in or near any school bus operated by Nevertardy Transit, LLC. 3. Agree not to sue Releasees for any loss, damage, injury or death described above and I will indemnify and hold harmless Releasees from any loss, liability, damage or cost they may incur due to said minor’s presence in, upon, or near the school buses operated by Nevertardy Transit, LLC, whether caused by the negligence of Releasees of otherwise. 4. Assume full responsibility for, and risk of, bodily injury, death or property damage due to the negligence of Releasees or otherwise. 5. Authorize Nevertardy Transit, LLC as agent for the undersigned, to consent with respect to said minor, to any x-ray examination, anesthetic, medical, dental, or surgical diagnosis or treatment, and hospital care which is deemed advisable by and is to be rendered under general or special supervision of, any physician and surgeon licensed under the provisions of the California Medical Practice Act, or the medical staff of any hospital, whether such diagnosis or treatment is rendered at the office of the physician or at the hospital. I understand that Nevertardy Transit, LLC is not responsible for costs incurred for medical or hospital care. 6. Acknowledge that Nevertardy Transit, LLC is not responsible for transporting students arriving at pickup locations after scheduled departure time, items lost or stolen on the bus, or issuing refunds in the event of cancellation by parent/guardian. 7. Acknowledge my responsibility to have student at pickup location not later than scheduled departure time and have student met at drop off point if deemed necessary by myself. 8. Acknowledge financial responsibility for vehicle damage caused by passenger. 9. Acknowledge that Nevertardy Transit, LLC reserves the right to refuse or cancel service at any time if rider does not comply with passenger behavior expectation including but not limited to: following the directions of the bus driver, remaining seated while the bus is moving, respecting the rights of others, and exercising self control. 10. Acknowledge that there are no refunds in the event of temporary school closure due to unforeseen circumstances. I intend this document to be as broad and inclusive as is permitted by the laws of the State of California; if any portion hereof is held invalid, I agree the balance shall continue in full force and effect.
